The term sheet is a summary. Where it differs from the full terms below, the full terms prevail.

Section IThe parties and these terms

These Terms of Use are an agreement between you and K.D.E.P. INVESTMENT LTD, registered in the Republic of Cyprus, of 17 Megalou Alexandrou, Aglantzia, Nicosia 2121, Cyprus (“K.D.E.P.”, “we”, “us”). You accept them by visiting the Website or using one of our Apps; if you do not accept them, please use neither. Accepting for a company or another organisation? Then you confirm that you have the authority to commit it.

Every App additionally comes under our End User License Agreement (“EULA”), which wins over these terms where the two disagree about that App, and under any terms the App itself shows you. Our Privacy Policy explains how we handle personal data.

Section IIWords with a special meaning

“Website” means kdep-investment.com. “App” means a mobile application we publish on the Apple App Store. “Services” means the Website and the Apps together. “Apple” means Apple Inc. and, where relevant, its affiliates. “Consumer” means a person using the Services for purposes outside their trade, business or profession.

Section IIINot an investment business

“Investment” is part of our company name and nothing more. We develop software. We do not provide investment services or financial advice, do not hold money on behalf of clients and do not offer shares or other securities. Nothing on the Website or in the Apps is an offer, solicitation or recommendation of that kind.

Section IVAccounts

Where an App offers accounts, please register with accurate information, keep your login private and let us know promptly if someone misuses it. Activity on your account is your responsibility, except where we caused it by not taking reasonable care. To close the account, use the delete option in the App if there is one, or e-mail us.

Section VPaying for apps and subscriptions

  1. Apple sells and bills every in-app purchase under its own terms; your card details never reach us.
  2. Before you confirm, the App shows the price, the billing period and any free trial or introductory offer. Prices differ from country to country and may include tax.
  3. A subscription renews automatically for the same period at the price then in force, unless you turn off auto-renewal at least 24 hours before the period ends. Apple charges your Apple Account for the next period during those last 24 hours.
  4. A free trial or introductory price, once over, rolls into the standard subscription price; cancel no later than 24 hours before it expires if you do not want that. Buying a subscription during a free trial brings the rest of the trial to an end.
  5. You manage and cancel subscriptions in the settings of your Apple Account. Deleting an App does not stop its subscription; a cancellation takes effect once the paid period runs out.
  6. Apple decides on refunds under its own rules. We cannot refund App Store purchases ourselves, but we will gladly help you ask Apple.
  7. We will tell you about price changes in advance, as Apple’s rules and the law require.
  8. Consumers in the European Union may have a 14-day right to withdraw from some purchases; for App Store purchases it is exercised through Apple. Mandatory consumer law applies whatever these terms say.

Section VIFair use

Please do not use the Services to:

  • act unlawfully or violate the rights of others;
  • copy, modify, decompile or reverse engineer the Services or make derivative works, except where the law allows it;
  • get around security, licence or payment checks;
  • scrape the Services, overload them or interfere with our servers and networks;
  • upload malware, or unlawful, harmful or offensive content;
  • pretend to be someone else or misstate a connection with anyone;
  • resell the Services or use them commercially without our written consent.

Section VIIWho owns what

The Services — software, design, text, images, names and logos — belong to us or to our licensors. Within the limits of these terms and the EULA, you receive a personal, limited, non-exclusive, non-transferable and revocable right to use them for non-commercial purposes; all other rights remain ours. Ideas and feedback you send us may be used to improve the Services without any duty to pay you.

Section VIIIYour content

What you create or upload in an App remains your property. We may store, process and display it solely to run the App for you, and you confirm that you have the rights needed for that.

Section IXServices run by others

The Services may link to, or rely on, features run by other companies — Sign in with Apple and Apple’s payment sheet, for example. Those features follow their providers’ own terms and privacy policies, and we are not responsible for them.

Section XChanges to the services

Features may be added, altered or withdrawn. We aim for the Services to be available at all times, but we cannot promise that maintenance, updates or events outside our control will never interrupt them. If a change substantially reduces a feature you paid for, we will tell you in advance where we reasonably can, and you may cancel as described in Section V, point 5.

Section XIOur promise about quality

We provide the Services with reasonable care and skill. Beyond that promise and the guarantees the law gives you, they are supplied “as is” and “as available”, with no warranty that they will run without interruption or error or suit a particular purpose. Your rights as a Consumer are not affected.

Section XIILimits of our liability

  1. These terms do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to exclude or limit.
  2. Apart from that, we are not liable for loss that could not reasonably have been foreseen, for loss of profit, income, contracts or business information, or for failures caused by events beyond our reasonable control.
  3. Apart from point 1, our total liability in connection with the Services is limited to EUR 100 or the amount you paid for the App or subscription concerned in the twelve months before the claim arose, whichever is greater.

Section XIIIEnding the relationship

You may stop using the Services whenever you wish. We may suspend or end your access after a serious or repeated breach of these terms, if a legal obligation demands it, or where that is necessary to keep the Services and their users safe; where reasonable, we will give notice and explain why. Sections III, VII, XI, XII, XV and XVI continue to apply afterwards.

Section XIVUpdating these terms

These terms can change when the Services or the law do. The version in force and its date are always on this page. Significant updates are announced beforehand in the App, or by e-mail if we have your address. Using the Services after an update takes effect means you accept it; if you do not, stop using them.

Section XVLaw, courts and complaints

These terms, and any non-contractual obligations connected with them, are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction over disputes. A Consumer living in the European Union keeps the protection of the mandatory law of their country of residence and may also bring a claim there. Please write to us first: most issues are settled by a quick e-mail.

Section XVIMiscellaneous

If a court finds any part of these terms invalid, the rest remains in force. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor in a reorganisation, merger or sale of the business, as long as your rights are not reduced. These terms, the EULA and the Privacy Policy form the whole agreement between you and us about the Services.
